1. Definitions and Interpretation
In these Terms and Conditions:

“Company”, “we”, “us”, “our” means Myni Jewellery Limited.

“Customer”, “you”, “your” means any individual purchasing goods from us.

“Goods” means any jewellery products supplied by us.

“Bespoke Goods” means goods that are custom-made to your specification.

“Order” means your request to purchase Goods from us.

“Contract” means the legally binding agreement formed between you and us.
2. Company Information
Myni Jewellery Limited is a private limited company registered in England and Wales under company number 17023492, with its registered office at 70 Marsland Road, Sale, M33 3HG.
3. Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts to place an Order with us.
4. Nature of Goods
4.1 All Goods sold by us are handmade, fine jewellery and are custom made-to-order based on your individual specifications.
4.2 Due to the bespoke nature of the Goods, variations in appearance may occur and shall not be considered defects.
4.3 Information regarding materials, including hallmarking and compliance, is provided separately in our Dealer’s Notice.
4.4 Images, photography, and visual representations of Goods on our website are provided for illustrative purposes only. Due to the bespoke and handcrafted nature of our products, the final Goods may vary in appearance, including but not limited to colour, size, stone characteristics, and finish.
4.5 Certain images used on our website may include licensed stock imagery or digitally generated visuals for illustrative purposes only and may not represent exact items previously created.
5. Consultation and Design Process
5.1 Our service begins with a non-binding consultation phase, during which you may share ideas, inspirations, and requirements.
5.2 A complimentary consultation will be arranged via voice or video call.
5.3 During this stage, we will discuss design preferences, materials, stone sourcing, budget, and timelines.
5.4 Following consultation, we will provide:

A design proposal (including CAD design)

Pricing
-
Estimated timelines
5.5 You may request design revisions during this phase.
5.6 No Contract is formed during this stage, and you may withdraw without obligation prior to design approval.
6. Order Process and Contract Formation
6.1 A Contract is formed only when:

You approve the final design; and
-
You pay the required 50% deposit.
6.2 Upon payment of the deposit, your Order becomes binding.
7. Pricing and Payment
7.1 All prices are provided during the design phase and confirmed upon final approval.
7.2 To commence production:
-
A 50% non-refundable deposit is required.
7.3 The remaining 50% balance must be paid prior to dispatch.
7.4 We reserve the right to delay production or delivery until full payment is received.
8. Design Approval and Customer Responsibilities
8.1 You are responsible for ensuring all specifications, including sizing and design details, are accurate prior to approval.
8.2 Once approved, the design is deemed final and accepted.
8.3 We are not responsible for errors resulting from incorrect information provided by you.
9. Production and Delivery
9.1 All Goods are handcrafted by skilled craftsmen using gold or silver.
9.2 Production timelines are estimates and may vary depending on complexity and sourcing.
9.3 Delivery is available within the United Kingdom only.
9.4 We are not liable for delays outside our reasonable control.
10. Risk and Ownership
10.1 Risk in the Goods passes to you upon successful delivery.
10.2 Ownership of the Goods transfers only upon receipt of full payment.
11. Cancellation Rights
11.1 Due to the bespoke nature of the Goods, your right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply once production has begun.
11.2 By approving the design and paying the deposit, you expressly acknowledge and accept:

The Goods are personalised; and

Your statutory cancellation rights are waived.
11.3 Prior to design approval, you may cancel without charge.
12. Returns, Refunds and Exchanges
12.1 As all Goods are bespoke and made-to-order:

We do not accept returns, refunds, or exchanges once production has commenced.
12.2 Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.
12.3 If Goods are:

Faulty;
-
Not as described; or
-
Not of satisfactory quality,
you may be entitled to a repair, replacement, or refund in accordance with UK law.
13. Warranty and Repairs
13.1 We provide a 12-month manufacturing warranty from the date of delivery.
13.2 This warranty covers defects in workmanship only.
13.3 The warranty does not cover:

General wear and tear
-
Accidental damage
-
Misuse or improper care
-
Third-party alterations
13.4 After the warranty period, we may offer repairs at additional cost.
14. Customer Responsibilities
You agree to:

Provide accurate and complete information

Carefully review all designs before approval
-
Follow care instructions provided
Failure to do so may affect your rights under warranty or consumer law.
15. Intellectual Property
15.1 All designs, CAD models, images, and related materials remain the intellectual property of Myni Jewellery Limited.
15.2 You may not reproduce, copy, or use our designs for commercial purposes without our prior written consent.
16. Limitation of Liability
16.1 Nothing in these Terms excludes or limits liability for:

Death or personal injury caused by negligence

Fraud or fraudulent misrepresentation
Any rights under the Consumer Rights Act 2015
16.2 Subject to the above, we shall not be liable for:

Indirect or consequential losses

Loss of profit, business, or opportunity
16.3 Our total liability shall not exceed the total amount paid for the Goods.
17. Force Majeure
We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to:

Natural disasters

Supply chain disruptions
-
Industrial disputes
18. Privacy and Data Protection
18.1 We process personal data in accordance with applicable UK data protection laws, including the UK GDPR.

19. Governing Law and Jurisdiction
These Terms and any disputes arising from them shall be governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction.
